General Terms and Conditions of Use for Event Facilities at FLYINGGROUP, Antwerp International Airport

1. Definitions

  • Lessor: FLYING SERVICE NV, registered under company number BE 0424.612.055, located at Antwerp Airport, Luchthavenlei 1b18, 2100 Antwerp, Belgium.
  • Tenant: The individual or legal entity renting the facilities, as identified in the Rental Agreement.
  • Facilities/Premises: The event spaces and associated utilities rented, as specified in the Rental Agreement.

2. Rental Terms

  • Rental Duration: The rental term is fixed, commencing and concluding on the dates and times specified in the Rental Agreement.
  • Rental Fee: The rental price is specified in the Rental Agreement and must be paid by the date stated on the invoice. Late payment may result in the agreement being rendered null and void without liability to the Lessor.

3. Cancellation Policy

  • Cancellation by Tenant: The Tenant may cancel the agreement up to 14 days before the rental period begins. In such cases, a cancellation fee of EUR 250 plus any incurred costs will be charged.
  • No Cancellation After 14 Days: Cancellations within 14 days of the rental period are not permitted, and the full rental fee is payable.
  • Fixed Term: The rental period cannot be altered once agreed, regardless of actual usage duration.

4. Tenant’s Responsibilities

  • Intended Use: The Tenant will use the premises solely for the event described in the Rental Agreement.
  • Liability: The Tenant is responsible for any damage to the premises, utilities, and objects within, including those caused by third parties admitted by the Tenant.
  • Insurance: The Tenant must obtain liability insurance with a minimum coverage of EUR 5 million per occurrence. A certificate of insurance must be provided to the Lessor before the rental period begins.
  • Compliance: The Tenant must comply with all relevant legal, regulatory, and safety obligations, including airport security and police regulations.
  • Event Management: The Tenant is responsible for all taxes, fees, and compensations related to the event. Alcohol service to individuals under 16 is prohibited. Smoking is only allowed in designated areas.
  • Premises Condition: The Tenant must return the premises in their original condition. Any damages incurred during the rental period will be the Tenant’s responsibility.

5. Lessor’s Rights

  • Access: The Lessor retains the right to access the premises at any time during the rental period.
  • Surveillance: The Lessor may monitor the premises via surveillance cameras.
  • Intervention: If the Tenant’s activities deviate from the agreed purpose or violate laws or regulations, the Lessor may suspend or cancel the event, with all associated costs borne by the Tenant.

6. Airside Access

  • Restricted Areas: Access to secure airside areas of the airport is restricted and requires proper clearance and supervision. The Lessor will require identification documents from the Tenant’s staff to clear access to these areas. This access is subject to an evaluation and formal authorization by the Airport Safety Team. The Lessor has no influence over this authorization process and, therefore, cannot be held responsible for its outcome.

7. Return of Premises

  • Condition: The premises must be returned in the condition they were received. The Tenant is liable for any damage caused during the rental period.
  • Liability for Delay: If the premises are not vacated within 2 hours of the rental period’s end, the Tenant will be charged EUR 250 per additional hour.

8. Lessor’s Liability

  • Exclusions: The Lessor is not liable for the Tenant’s personal property or for any interruption of utilities beyond the Lessor’s control.

9. Dispute Resolution

  • Jurisdiction: Any disputes arising from this agreement will fall under the exclusive jurisdiction of the courts where the Lessor is based.

These General Terms and Conditions are intended to govern the use of FLYINGGROUP’s facilities and form an integral part of the Rental Agreement. The Tenant’s signature on the Rental Agreement signifies acceptance of these terms.
